Work permits and LMIA (Labour Market Impact Assessment) applications
Work Permits and LMIA Applications
Canada offers various types of work permits for foreign nationals wishing to work temporarily in the country. In most cases, a Canadian employer must first obtain a Labour Market Impact Assessment (LMIA) before a foreign worker can apply for a work permit.
The LMIA is a formal approval issued by Employment and Social Development Canada (ESDC). It confirms that there is a genuine need for a foreign worker to fill a specific job, and that no Canadian citizen or permanent resident is available to do so. A positive LMIA is often referred to as a “confirmation letter,” which must be included in the work permit application submitted to Immigration, Refugees and Citizenship Canada (IRCC).
Our services include:
Legal guidance for Canadian employers on the LMIA application process
Preparation and submission of complete LMIA files (high-wage or low-wage streams)
Support with advertising and recruitment efforts required by ESDC
Coordination with foreign candidates for the submission of work permit applications
Assistance with employer compliance and renewal of existing work permits
There are also work permits that are LMIA-exempt, such as those under international agreements (e.g., CUSMA), intra-company transfers, or open work permits for spouses and students. We assess each client’s situation individually to determine the most effective path.
Navigating LMIA and work permit procedures can be complex and time-sensitive. Our legal team ensures that each step is handled with precision to maximize the chances of approval and reduce delays.
